Client wants to determine the correct tax forms to file as an\u00a0 individual taxpayer in the US.\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Queries \/ Requirements from the Clients:\u00a0<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Query 1: Appropriate tax form Kyrian needs to file at the IRS?<\/h3>\n\n\n\n<h3 class=\"wp-block-heading\"><em>My Opinion \/ Reply:\u00a0\u00a0<\/em><\/h3>\n\n\n\n<p class=\"has-medium-font-size\" style=\"line-height:1.7\"><strong>Form 1040 US Individual Income Tax Return \u2013 <\/strong>This form is used by most taxpayers\u00a0 to report their Income, Deductions and Credits. There are several variations of Form \u00a01040 depending on taxpayers filing status i.e. Single, Married Filing Jointly,\u00a0 Married Filing Separately, Head of Household, Income Level and other factors. For\u00a0 example taxpayers with more complex tax situations may need to file Form 1040\u00a0along with Schedule A to itemize their deductions OR Form 1040 along with\u00a0 Schedule C to report self employment income.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Query 2: Tax Form that should have been used if the Client was 65 and not 29\u00a0 years?\u00a0\u00a0<\/h3>\n\n\n\n<h3 class=\"wp-block-heading\"><em>My Opinion \/ Reply:\u00a0\u00a0<\/em><\/h3>\n\n\n\n<p class=\"has-medium-font-size\" style=\"line-height:1.7\"><strong>Form 1040 \u2013 SR \u2013 US tax Returns for Senior \u2013<\/strong> This form is meant for people who\u00a0 are 65 years and above in US. Dependent can be child, parent or\u00a0 relative.\u00a0<\/li>\n<\/ul>\n\n\n\n<p class=\"has-large-font-size\">\u00a0<strong>Qualifying Surviving Spouse (QSS):<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-medium-font-size\"><strong>Rule 1: <\/strong>Up to 2 years after death of spouse, not remarried<\/li>\n\n\n\n<li class=\"has-medium-font-size\"><strong>Rule 2: <\/strong>Dependent Child (Own child, Stepchild, Adopted child) lives at\u00a0 taxpayer\u2019s home for whole year and taxpayer provides > 50% of cost of\u00a0 household\u00a0<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Query 7: What would be the filing status for the Client, if his marital status\u00a0 changes from Single to Married as at December 31, 2022?\u00a0<\/h3>\n\n\n\n<h3 class=\"wp-block-heading\"><em>My Opinion \/ Reply:\u00a0<\/em><\/h3>\n\n\n\n<p class=\"has-medium-font-size\" style=\"line-height:1.7\">His options would be one of the two stated as under:&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-medium-font-size\" style=\"line-height:1.7\">\u00a0Married filing jointly (MFJ) i.e. Married as of year end, OR spouse dies\u00a0 during the year and surviving spouse does not remarry OR, Living apart\u00a0 Married filing separately (MFS) i.e. Each spouse filing separately\u00a0<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Query 8: Client had paid taxes 27 months ago but did not file a return and\u00a0 now he wants to claim a refund of Federal Income Tax that was paid at that\u00a0 time. Client seeks to know how and when claim for refund can be filed?\u00a0\u00a0<\/h3>\n\n\n\n<h3 class=\"wp-block-heading\"><em>My Opinion \/ Reply:\u00a0<\/em>\u00a0<\/h3>\n\n\n\n<p class=\"has-medium-font-size\" style=\"line-height:1.7\">According to Publication # 556 of September, 2013, Form 843 can be used\u00a0 by Taxpayers to claim a refund (or abatement) of certain overpaid (or over assessed) taxes, interest, penalties, and additions to tax.\u00a0<\/p>\n\n\n\n<p class=\"has-large-font-size\"><strong>Section 6511(a) of IRC cites as following:\u00a0<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li style=\"line-height:1.7\" class=\"has-medium-font-size\">The latest date, by law, you can claim a credit or federal income tax refund for\u00a0 a specific tax year is generally the later of these 2 dates:\u00a0\n<ul class=\"wp-block-list\">\n<li>3 years from the date you filed your federal income tax return, <strong>OR<\/strong> <\/li>\n\n\n\n<li>2 years from the date you paid the tax.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"has-medium-font-size\" style=\"line-height:1.7\">This time period is called the Refund Statute Expiration Date (RSED).\u00a0 Here Client did not file the return and paid taxes 27 months ago, the time limit\u00a0 to file for refunds for him is 2 years from the date of tax payment. Therefore\u00a0 Client can\u2019t file for a refund.\u00a0\u00a0As per IRC Section 6511(b)(1), no credit or refund shall be allowed or made\u00a0 after the expiration of the period of limitation prescribed in Section 6511(a) for\u00a0 the filing of a claim for refund, unless a claim is filed within such period.\u00a0<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>However, deadlines for claiming a refund can be extended if:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-medium-font-size\">\u00a0<strong>Agreement with the IRS in writing to extend the time limit to assess\u00a0 tax:<\/strong> The time limit is specified in your agreement, plus 6 months, to\u00a0 claim a credit or refund.
